MPCA’s 401 for Line 3 upheld in appeals court

The Enbridge Line 3 pipeline project withstood another challenge from opponents Monday.

The Minnesota Court of Appeals affirmed a decision by state pollution regulators to issue a water quality certification for the project.

Opponents say the court “failed” the people of Minnesota and the state’s natural resources.

The appeals court ruled that “substantial evidence” supported the Minnesota Pollution Control Agency’s approval of the section 401 certification.

The decision was made last November after thousands of public comments and included 35 conditions.

The 401 certification, per the Clean Water Act, mitigates pollutant discharge into public waterways.
