Prosecution not warranted in March officer-involved shooting in Backus

The Cass County Sheriff’s Office has finished its review of the homicide and officer involved shooting incident in Backus last March.

According to a letter from Attorney Ben Lindstrom to BCA Agent Paul Gherardi, no formal prosecutions are warranted because the only prosecutable party was killed in the incident, and the Deputy’s actions, of firing the weapon and killing the suspect, were authorized by law.

Deputy Mike Germain responded to a home invasion involving a firearm March 8, and upon investigating, learned that Keith Haux murdered his neighbor, Maynard Anderson.

Deputy Germain encountered and ordered Haux to put down his weapon, who ignored that order.

Surveillance footage and forensic examination of spent casings in the incident support the decision, according to Lindstrom.
