The Minnesota Board of Pharmacy has filed a civil lawsuit against Northland Vapor in Clay County.
The company operates in Moorhead and Bemidji.
Under a new law legalizing recreational edible marijuana products, no more than 5 milligrams of any hemp-derived THC in a single serving or 50 mg in a package is permitted.
The new law also stipulates that edible cannabinoid products cannot resemble cartoons or model after brands primarily marketed to children.
The U.S. Food and Drug Administration received a number of complaints associated with Northland Vapor’s “Death by Gummy Bears” products, including a death.
The FDA and the Minnesota Board of Pharmacy are conducting a joint investigation.
Last month, an inspection at the Northland Vapor manufacturing warehouse in Moorhead found packages that far exceed the THC limits per serving and per package, matching products found on the companies’ websites and retail locations.
The non-compliant product was embargoed, with an estimated value that exceeds $7 million.
The investigation is still underway, according to the release.
